Primary Essentials is a membership and community operated by Phonics to Fluency. This site provides free and paid access to community features, downloadable resources, and related content for PreK-2 teachers and educators.
You must be at least 18 years old, or the age of majority in your location, to use this site or purchase a membership. By using this site, you represent that you meet this requirement and that any information you provide is accurate and complete.
To access certain parts of the site, including the free community or paid membership, you may need to create an account.
You agree to:
provide accurate and current account information
keep your login information secure
be responsible for all activity under your account
notify us promptly of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these terms or misuse the site.
Primary Essentials may offer both free and paid access levels.
The free community may include discussion access, updates, and occasional freebies. Free community access does not include the full paid resource library unless specifically stated.
Paid members receive access to the resources, downloads, and membership features included in the plan they purchased, for as long as their membership remains active.
We reserve the right to update, change, add, or remove membership features, resources, and content at any time in order to improve the membership, maintain quality, or respond to business needs.
If you purchase a paid membership, you agree to pay all fees associated with your selected plan.
If you choose a monthly or annual subscription, you authorize recurring charges based on your selected billing cycle until you cancel.
Monthly memberships may be canceled at any time. Your access will continue through the end of your current billing period unless otherwise stated.
Annual memberships remain active for the full term purchased and will renew according to the plan terms unless canceled before renewal.
If a payment fails, your access may be paused or removed until billing is successfully completed.
Because Primary Essentials includes immediate access to digital content, downloads, and membership materials, all sales are final unless otherwise stated.
If you have a billing issue or believe there has been an error, please contact us and we will review the issue.
The resources included in Primary Essentials are for your personal classroom or professional use only, unless otherwise stated.
You may not:
resell, share, distribute, or forward membership resources to others
upload membership files to shared drives, public sites, forums, or marketplaces
claim the resources as your own
use the resources in a way that violates copyright or intellectual property rights
Membership access is granted to one purchaser only unless a separate license is clearly provided.
If you participate in the community, discussions, comments, or other interactive areas, you agree to behave respectfully.
You may not:
post unlawful, abusive, harassing, threatening, or defamatory content
post spam, promotional junk, or misleading information
impersonate another person
upload viruses, malicious code, or harmful files
post content that infringes another person’s rights
share private or sensitive information about others without permission
We reserve the right to remove content, restrict access, or terminate accounts that violate these rules.
If you post comments, questions, ideas, files, or other content in the community, you remain responsible for what you share.
By posting content on the site, you grant us a non-exclusive right to display, reproduce, and use that content as needed to operate the community and membership, unless otherwise prohibited by law.
We are not responsible for user-posted content and do not guarantee the accuracy or reliability of any comments or community discussions.
All content on this site, including downloads, graphics, branding, text, videos, resource files, and membership materials, is the property of Phonics to Fluency and/or its licensors and is protected by copyright and other intellectual property laws. The original terms you shared also make clear that content is protected and not to be used or distributed beyond permitted use.
You may not copy, reproduce, modify, sell, or distribute any part of this site or membership except as expressly allowed.
This site may use third-party services and tools for payments, membership delivery, email communication, analytics, embedded content, or community features.
We are not responsible for the policies, content, or practices of third-party services or websites. Your use of those services may also be subject to their terms and policies.
Primary Essentials is designed to provide practical support and resources, but we do not guarantee any specific results from using the site, membership, downloads, or community.
We do not guarantee that:
the site will always be available without interruption
all content will always remain available
the membership will meet every user’s specific needs
the site will be free from errors or technical issues
All content, resources, and information provided through Primary Essentials are offered for educational and informational purposes only.
The site and membership are provided “as is” and “as available.” We make no warranties, express or implied, regarding availability, accuracy, reliability, or fitness for a particular purpose. The terms you provided include this same general disclaimer structure, which I adapted for your membership site.
To the fullest extent permitted by law, Phonics to Fluency and Primary Essentials will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site, membership, community, or downloads.
Our total liability for any claim related to your use of the paid membership will not exceed the amount you paid to us in the three months before the event giving rise to the claim, or $100, whichever is greater. The version you shared used a similar limitation framework, which I simplified for your site.
We reserve the right to suspend or terminate your access to the free community, paid membership, or site at any time if you violate these Terms of Service or misuse the site or resources.
If your account is terminated for violating these terms, you may lose access to the membership without refund.
We may update these Terms of Service at any time. If changes are made, the updated version will be posted on this site with a revised effective date.
Your continued use of the site after changes are posted means you accept the updated terms.
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of South Carolina, without regard to conflict of law principles.
